EB-2 Eligibility: Two Qualifying Tracks

USCIS recognizes two ways to qualify for the EB-2 category. Most applicants still need a U.S. employer to sponsor them, but the requirements differ meaningfully between tracks.

Advanced Degree Professionals

This track covers applicants who hold a U.S. advanced degree or a foreign equivalent. A U.S. bachelor’s degree plus at least five years of progressive work experience in the field also qualifies, because USCIS treats that combination as equivalent to a master’s degree. The sponsored position must also require an advanced degree.

Exceptional Ability in Science, Arts, or Business

This track requires demonstrating a level of expertise significantly above others in the field. USCIS evaluates a combination of evidence: academic degrees, professional licenses, high salary relative to peers, memberships in professional associations, and published recognition of the applicant’s work. No single factor is decisive.

For most EB-2 applicants, employer sponsorship is a prerequisite. The employer conducts a PERM labor certification process with the Department of Labor before filing the I-140 petition. One significant exception exists: the National Interest Waiver.

The National Interest Waiver: Self-Petitioning Without an Employer

A National Interest Waiver (NIW) allows a qualified applicant to bypass the job offer and labor certification requirement entirely. USCIS applies a three-prong standard called the Dhanasar framework, requiring the applicant to show that (1) the proposed endeavor has substantial merit and national importance; (2) the applicant is well-positioned to advance that endeavor; and (3) it would benefit the United States to waive the job offer and labor certification requirements.

Researchers, scientists, healthcare professionals, engineers, entrepreneurs, and academics have each obtained NIWs, though USCIS reviews petitions case by case. An approved NIW lets the applicant and qualifying immediate family members pursue permanent residence without depending on any single employer’s continued support. Premium processing is available for the I-140 and can reduce initial adjudication time significantly.

A persuasive NIW petition requires detailed documentation of the applicant’s work and its impact, along with a national-interest argument that connects individual contributions to outcomes beyond the local or regional level.
