L-1 Eligibility: Key Requirements

Three elements determine whether an L-1 petition can proceed. First, the foreign and U.S. entities must share a qualifying corporate relationship as a parent, branch, subsidiary, or affiliate. Second, the beneficiary must have worked for that qualifying organization abroad for at least one continuous year in the three years preceding the filing. Third, the U.S. role must fall within the L-1A managerial or executive category or the L-1B specialized knowledge category.

New office petitions, filed when the U.S. entity has been operating for less than one year, carry additional requirements. USCIS generally expects evidence of secured physical premises and a credible business plan. Initial approval is limited to one year rather than the standard three, with extensions available once the office demonstrates it has grown as projected.
