EB-1 Eligibility: What Each Category Requires
Each of the three EB-1 categories has its own eligibility standard, and none requires PERM labor certification, which is one reason this category can move faster than most employment-based routes.
EB-1A: Extraordinary Ability
To qualify, an applicant must show sustained national or international acclaim through either a single major internationally recognized award or evidence satisfying at least 3 of 10 regulatory criteria, such as published original contributions, high-salary evidence, or judging the work of others. EB-1A is also the only category that permits self-petitioning: no employer sponsor or job offer is required.
EB-1B: Outstanding Professor or Researcher
This category requires an employer sponsor and evidence meeting at least 2 of 6 regulatory criteria. It’s designed for academic researchers and professors with international recognition in a specific discipline, and the sponsoring employer must offer a permanent research or teaching position.
EB-1C: Multinational Manager or Executive
Applicants must have worked for a qualifying overseas affiliate, parent, or subsidiary in a managerial or executive role for at least one of the three years preceding the petition. The U.S. employer files the petition, and the role in the United States must also be managerial or executive in nature.
