Adjustment of Status

If a family member is already in the United States in a lawful status, they may be able to obtain lawful permanent residence through adjustment of status without leaving the country. Eligibility generally requires physical presence in the United States, a lawful entry, an approved visa petition, and no disqualifying change in circumstances such as the death of the petitioner. Consular Processing

For family members outside the United States, or who can’t adjust status domestically, the path to a family-based green card runs through consular processing. After USCIS approves the petition and a visa number becomes available, the National Visa Center collects documents and schedules the consular interview. The foreign national attends the interview at a U.S. embassy or consulate abroad and, if approved, can enter the United States as a lawful permanent resident.

Petitioning for a Spouse

Spousal petitions follow the same Form I-130 starting point, but the path forward depends on whether the petitioner is a U.S. citizen or a lawful permanent resident.

A U.S. citizen’s spouse is an immediate relative, so no numerical cap applies. Once USCIS approves the I-130, the spouse moves directly to the immigrant visa stage. A lawful permanent resident’s spouse falls under the 2A preference category and is subject to annual limits. Wait times can exceed two years depending on demand and country of chargeability.

Once the petition is approved and a visa number is available, the next step depends on where the spouse is located. A spouse physically present in the United States may file Form I-485 to adjust status. A spouse abroad completes the process through consular processing at their local U.S. embassy or consulate.

If a spouse entered the United States without authorization, they may have accrued unlawful presence that triggers a bar upon departure. Individuals who depart after accruing more than 180 days but less than one year of unlawful presence may face a three-year bar from reentry. Those who accrue one year or more may face a 10-year bar. In certain circumstances, the I-601A provisional unlawful presence waiver may be available. We advise clients on whether a waiver may apply and what steps are available before any travel takes place. Complete, well-organized documentation from the start can also reduce the risk of a Request for Evidence from USCIS, which can extend timelines significantly.

K-1 Fiancé Visas

U.S. citizens can petition for a foreign-national fiancé through the K-1 visa process. A K-1 visa allows the fiancé to enter the United States for the purpose of marriage. The couple must marry within 90 days of the fiancé’s arrival, after which the fiancé can apply for adjustment of status to obtain a green card.

The process begins with filing Form I-129F with USCIS, supported by evidence of the relationship, including photographs, communication records, and proof of in-person meetings. Once USCIS approves the petition, the fiancé applies for the visa at a U.S. consulate abroad.
