The PERM Labor Certification Process, Step by Step

Prevailing Wage Determination

Before recruitment begins, the employer submits Form ETA-9141 to the DOL’s National Prevailing Wage Center. The employer can’t begin the formal recruitment campaign until this determination is in hand.

Recruitment Campaign

For professional occupations, the DOL requires a structured recruitment campaign designed to test the U.S. labor market. Mandatory steps include:

• State workforce agency job order posted for 30 consecutive days
• Two Sunday newspaper advertisements in a major newspaper of general circulation in the area of intended employment
• Internal job posting at the worksite for 10 consecutive business days
• Three additional recruitment steps chosen from DOL-approved options such as job fairs, campus recruitment, online job boards, trade organizations, or employee referral programs

After completing the job order and most recruitment steps, the employer must wait an additional 30 days before filing. During that window, the employer documents outcomes: Every U.S. applicant considered must be evaluated, and any rejection must be supported by a lawful, job-related reason. Those records must be retained for five years.

Filing ETA Form 9089

The PERM application is submitted electronically through the DOL’s FLAG system using ETA Form 9089. There is no filing fee. If the DOL approves the application, the employer’s next step is filing an I-140 Immigrant Petition for Alien Workers with USCIS. The priority date for the foreign national employee’s place in the visa queue is established on the date the PERM application was filed, not the date it is approved, which makes timely filing strategically important for nationals of countries with backlogged visa categories.

DOL Audits: What Employers Need to Know

The DOL reviews a significant share of PERM applications through a combination of random selection and targeted review. Roughly 30% are randomly audited regardless of how carefully the application was prepared. Targeted audits can be triggered by specific application characteristics: positions that don’t require a bachelor’s degree, positions at public schools, or job descriptions the Office of Foreign Labor Certification flags as potentially tailored to the foreign national rather than the position.
