Who Qualifies for an EB-2 Green Card

USCIS evaluates EB-2 petitions under two distinct eligibility standards, and the documentation requirements differ meaningfully between them.

Advanced Degree Professionals

This path requires a U.S. advanced degree or its foreign equivalent, or a U.S. bachelor’s degree plus at least five years of progressive post-baccalaureate experience in the field. Progressive experience means increasing responsibility or complexity over time, not simply years in the same position. Most employer-sponsored EB-2 petitions fall under this category and require PERM labor certification before the I-140 immigrant petition can be filed with USCIS.

Exceptional Ability in Sciences, Arts, or Business

This path requires documentation showing a degree of expertise significantly above that ordinarily encountered in the field. USCIS applies six evidentiary criteria and requires applicants to satisfy at least three: an academic record relating to the area of exceptional ability, letters showing at least 10 years of full-time experience, a professional license or certification, evidence of a salary demonstrating exceptional ability, membership in professional associations, and recognition from peers or professional or government organizations. Meeting the threshold triggers a totality-of-the-evidence review, so a stronger showing across multiple criteria can reduce the risk of a request for evidence (RFE).

The National Interest Waiver: Self-Petitioning Without an Employer

An NIW allows an EB-2 applicant to petition without a specific employer sponsor by filing Form I-140 directly with USCIS. The trade-off is a higher evidentiary burden. USCIS applies the Matter of Dhanasar (2016) three-part framework to every NIW petition.

  • Substantial merit and national importance: The proposed endeavor must carry real-world implications beyond the petitioner’s personal benefit. STEM research, public health, national security, and economic development are commonly recognized, but the list isn’t exhaustive.
  • Well positioned to advance the endeavor: USCIS considers education, skills, a record of success, a plan for future work, and letters of support from experts or interested parties.
  • Beneficial to waive the requirements: USCIS weighs the benefit of the petitioner’s contribution against the labor market protections the standard requirements serve. The urgency of the need and the petitioner’s unique qualifications are relevant factors.

NIW candidates commonly include researchers, scientists, engineers, medical professionals, academics, and entrepreneurs. For many professionals in Northern Virginia who work adjacent to federal agencies or research institutions, the NIW can be a direct route to an employment-based green card.
