“Once Kilmar Abrego Garcia is formally released from criminal custody and transferred to ICE, his immigration case will resume. But make no mistake: the government has made clear it is willing to pull any trick—no matter how dirty—to get the result it wants.

We are asking the District Judge in Maryland to ensure that the Supreme Court’s mandate is honored, and that Mr. Abrego Garcia receives the same due process in his immigration proceedings that he is finally receiving in his criminal proceedings. “The government spent two months flouting the Supreme Court’s directive to facilitate Kilmar Abrego Garcia’s return to the United States. At the same time, they openly defied Judge Xinis’s order to produce contemporaneous evidence of their actions.

Now that they’ve finally brought Kilmar back—exposing the falsity of their claimed impotence—they want this case to disappear. But it cannot.

The government disappeared Kilmar to a foreign prison in violation of a court order. Now, after months of delay and secrecy, they’re bringing him back—not to correct their error, but to prosecute him. This shows that they were playing games with the court all along. Due process means the chance to defend yourself before you’re punished, not after. This is an abuse of power, not justice.

The government should put him on trial, yes—but in front of the same immigration judge who heard his case in 2019, which is the ordinary manner of doing things, “to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador,” as the Supreme Court ordered.

Judge Denies Government’s Second Delay Request in Abrego Garcia Case

Washington, D.C. This morning, U.S. District Judge Paula Xinis in Maryland denied the U.S. government’s request for a second one-week delay in the ongoing legal case concerning Murray Osorio PLLC client, Kilmar Armando Abrego Garcia, who remains unlawfully detained in El Salvador following his unlawful deportation from the United States.

Last week, attorneys for the U.S. Department of Justice requested a one-week stay of discovery proceedings, stating that the government needed time to take steps to return Mr. Abrego Garcia to the United States. We agreed to that request because we understood it to be made in good faith.

Unfortunately, one week later, it remains unclear what, if anything, the government has done in the past seven days to bring our client home to his family. During that time, White House Border Czar Tom Homan publicly asserted—contrary to all evidence—that Mr. Abrego Garcia’s deportation was not a mistake. Meanwhile, President Trump confirmed what we’ve long maintained: that he has the power to bring Mr. Abrego Garcia back with a single phone call, and that he has not made that phone call because his legal team told him not to do so.

Yesterday, the government requested a second one-week delay. This morning, the judge denied that request. Discovery will now proceed.

As this process continues, we will seek to determine who in the U.S. government has taken action to facilitate Mr. Abrego Garcia’s return, what specific steps they’ve taken, and who may have worked to block those efforts. These questions demand answers—and through discovery, we intend to obtain them.

Because discovery in this case will proceed under seal our attorneys will not be able to comment on the documents, testimony, or facts we obtain—unless and until they are filed on the public docket.

But let us be clear: we will pursue every legal avenue to secure Mr. Abrego Garcia’s return home to his family, so that he can get a full and fair trial on the allegations against him, and we won’t rest until that day comes.

We are deeply grateful to Senator Van Hollen for his determination and tireless advocacy. His efforts brought Mr. Abrego Garcia’s family the first proof that he is in fact alive. For the first time since his removal, Mr. Abrego Garcia was able to receive news of his family and learn that countless people in the United States are fighting for his safe return.

But let us be clear: Kilmar is not home. He remains imprisoned in El Salvador, cut off from his legal team, and still denied his constitutional right to due process. The United States government has yet to take meaningful action to comply with the Supreme Court’s directive to facilitate his return.

Yesterday’s decision from the Fourth Circuit Court of Appeals sent a clear and urgent message: the government’s failure to act is not only indefensible—it poses a serious threat to the rule of law. The Court condemned the continued detention of Mr. Abrego Garcia “without the semblance of due process,” calling it “shocking not only to judges, but to the intuitive sense of liberty that Americans… still hold dear.” In return, the government did not appeal to the Supreme Court, and discovery will continue.

We are encouraged by the Court’s recognition of what is at stake, and we welcome the discovery process. Securing Mr. Abrego Garcia’s return remains our top priority. We will not rest until he is back in the United States.

We are aware of the allegations being pushed by DHS in the media. To be clear: Mr. Abrego Garcia has never been convicted of a crime. If the government believes there is a legitimate case to be made, it should present that case in a court of law and have a judge review and decide his fate—not on social media. But that cannot happen until Mr. Abrego Garcia is returned to the United States and given full due process. These allegations, without more, prove why due process and access to counsel is so important.

We look forward to the government complying with the Court’s order and facilitating Mr. Abrego Garcia’s immediate release from custody in El Salvador. We will continue to fight for our client’s safe return and to ensure his constitutional rights are fully restored.

“The continued detention of Kilmar Abrego Garcia in El Salvador—despite a unanimous ruling by the United States Supreme Court—raises serious concerns about compliance and accountability. Mr. Abrego Garcia was unlawfully removed from his home and his family in Maryland. His deportation violated a standing immigration court order. The Supreme Court has since made clear that the U.S. government must facilitate his return. Yet days later, no plan has been announced, no steps made public, and no indication given that action is being taken. Instead, it seems the government's position is that no action is necessary.

Let us be clear: the responsibility to return Mr. Abrego Garcia lies squarely with the United States government. His deportation was not just an administrative error—it was a constitutional failure.

This should never happen to anyone. But it did happen—to a father, a husband, and a Maryland resident who had a right to be heard in court and who was instead sent to a foreign prison without due process.

We urge the Department of Homeland Security and the Department of State to act now—and with the urgency this moment demands. Delays in executing the Supreme Court’s directive are unacceptable. We call for immediate transparency and action to bring Mr. Abrego Garcia home.”

Washington, D.C. – The Trump administration filed a declaration in federal court stating that Kilmar Armando Abrego Garcia remains detained in the Terrorism Confinement Center in El Salvador—more than 24 hours after a unanimous decision by the U.S. Supreme Court ruled in Mr. Abrego Garcia’s favor. The filing included no plan for his return to the United States or timeline for compliance with the Court’s order. The following is a statement from Murray Osorio PLLC, counsel for Mr. Abrego Garcia:

We are disappointed yet again by the government’s response, this time following a unanimous ruling by the United States Supreme Court. More than 24 hours have passed since the Court’s decision, and there is still no clear indication of what has been done—or what is being planned—to comply with the ruling.

Today’s declaration confirms that Mr. Abrego Garcia remains in detention at the Terrorism Confinement Center in El Salvador. While the acknowledgment of his location is an overdue first step, it does nothing to address the government's obligation to return him safely and immediately to the United States.

The continued delay in executing a Supreme Court mandate is not only unacceptable—it is a direct affront to the rule of law. The Department of Homeland Security and the Department of State must act without further delay and provide full transparency about the steps being taken to ensure Mr. Abrego Garcia’s safe return.

His life and liberty remain in jeopardy. We expect immediate action and full accountability from the agencies involved.
