In the United States, individuals can apply for permanent residence through family sponsorship, employment opportunities, or recognized humanitarian grounds. Victims of serious crimes, domestic violence, or human trafficking may be eligible for relief, regardless of how they entered the country or their current immigration status. Children who have experienced abandonment, neglect, or abuse by one or both parents can seek status under Special Immigrant Juvenile Status, leading to eventual permanent residence.

Violence Against Women Act (VAWA) 

Survivors of domestic violence, regardless of gender, may find protection under the Violence Against Women Act (VAWA). VAWA provides safeguards for those who have suffered physical or mental abuse by their U.S. citizen or Legal Permanent Resident spouse. It is possible to simultaneously file for a green card application along with the VAWA petition.

U-Visas 

Victims of violent crimes, including domestic violence, armed robbery, or serious assault, can seek protection in the United States through a U-Visa. While the application is pending, victims may receive work authorization. Once granted, individuals receive work authorization and temporary status for four years. After three years in the United States on a U-Visa, victims and eligible family members may apply for legal permanent residence. Trafficking & T-Visas 

Victims of human trafficking and their families can petition for T-Visas if they report the crime to authorities and cooperate with the investigation. Immigrants with T-Visas can obtain work authorization and temporary status, which extends to eligible family members.

Humanitarian Asylum 

Individuals or families seeking refuge from persecution in their home country can apply for humanitarian asylum if they have a reasonable fear of returning. Humanitarian asylum applications are not based on a future fear of persecution due to race, religion, nationality, political opinion, or membership in a protected social group. Eligibility for humanitarian asylum can arise from severe past persecution or events such as civil war, extreme economic hardship, FGM, or natural disasters. Asylum law is constantly evolving and requires the careful attention of an experienced attorney.

Temporary Protected Status 

For individuals from countries that are unsafe due to situations like war or a natural disaster.  If the US government designates nationals from a specific country eligible for Temporary Protected Status (TPS) then those nationals must register for the benefit within a certain timeframe, must show that they have continuously resided in the US since the date designated by the US government, and that they do not have more than two misdemeanor criminal offenses.  Individuals with TPS can apply for Advance Parole to leave and re-enter the United States.
